Dear ALFI Board, Members and Friends:
On May 13, 2015, ALFI filed with the Supreme Court a Petition for Certiorari, Prohibition and Mandamus with Prayer for the Urgent Issuance of TRO and/or Writ of Preliminary Prohibitory and Mandatory Injunction. Our Petition questions the manner of implementation of the RH Law by DOH and FDA officials and all persons acting for and on their behalf, as being contrary to the RH Law and the Judgment of the Supreme Court (April 8, 2014), and carried out without observance of due process and with grave abuse of discretion amounting to lack or excess of jurisdiction.
The Supreme Court has now spoken. It has issued a TRO addressed to DOH and FDA and their agents and representatives and has ordered them to comment on our Petition. Specifically, they have been restrained from:
[1] granting any and all pending applications for registration and/or recertification for reproductive products and supplies including contraceptive drugs and devices; and [2] procuring, selling, distributing, dispensing or administering, advertising and promoting the hormonal contraceptive ”Implanon” and “Implanon NXT.” (Please see attached SC Resolution).
The legal battle is just taking shape. But I believe we have scored a very important point in the initial round. We have adequately demonstrated to the Court and to the Government that we mean business and that we are committed to carry our fight through until its logical end. The Government, through the DOH, is likewise put on notice that no one, even the high and mighty, should be above the law, and that the Filipino public will demand from its government the protection of their constitutional and statutory rights through every legal means possible. The name of the game now is VIGILANCE.
